Welcome to NextGen XR. By accessing or using our website (https://skillfullyhumantraining.com) or our services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our site or services.
1. Acceptance of Terms
These Terms & Conditions govern your use of the NextGen XR website and services. By purchasing or scheduling any training session, registering for events, or purchasing products, you agree to these Terms & Conditions in addition to any package-specific terms provided at checkout.
2. Use of Website
✓ The content on this website is provided for general informational and marketing purposes.
✓ You agree not to misuse the site, including attempting to hack, distribute malware, or infringe on intellectual property rights.
✓ You must be at least 18 years old to submit forms or requests through the site.
3. Services
✓ NextGen XR provides immersive training simulations, learning resources, and related services.
✓ Services may include immersive training simulations, workshops and events, augmented reality (AR) products such as AR Cards, and other digital or physical offerings.
✓ Information provided on the site does not guarantee results and is not a substitute for formal education, professional certification, or emergency training.
4. Workshops and Events
✓ Registration is confirmed upon full payment.
✓ Event fees are non-refundable but may be transferred to another participant if requested at least 7 business days before the event.
✓ NextGen XR reserves the right to reschedule or cancel an event. If cancelled, registrants will receive a full refund or the option to transfer registration to a future event.
✓ Event schedules, speakers, or agendas are subject to change without notice.
✓ Travel, lodging, and incidental expenses are the responsibility of the participant.
5. Product Sales (including AR Cards)
✓ All sales of physical products (including AR Cards) are final unless the product is defective or damaged upon delivery.
✓ Customers must notify NextGen XR of defective or damaged products within 7 days of receipt to request a replacement.
✓ Each AR Card purchase includes up to two (2) design revisions.
✓ Customers must submit all revision requests within 72 hours (3 business days) of receiving the initial design delivery.
✓ Timely feedback helps us and our vendors maintain project schedules. Revision requests received after this window may not be accommodated.
✓ If no revision requests are submitted within this timeframe, the design will be considered accepted and finalized.
✓ Design files and related materials are delivered digitally. Physical card delivery may involve shipping fees.
✓ Shipping and delivery timelines are estimates; NextGen XR is not responsible for delays outside its control.
✓ Intellectual property associated with AR Cards (designs, characters, scenarios) remains the property of NextGen XR. Customers are granted a license to use the cards for internal training purposes only.
6. Payment, Rescheduling, and Cancellations
✓ Payment & Confirmation: Sessions are confirmed only once payment is received in full. For events and product sales, payment is due in full at the time of registration or purchase and is non-refundable except as specified in Sections 3 and 4.
✓ Rescheduling: Sessions may be rescheduled with at least 7 business days’ notice.
✓ Cancellations: Less than 7 business days’ notice = non-refundable.
✓ Refund: Refunds only issued if cancellation occurs outside the rescheduling window or if NextGen XR cannot deliver the session.
✓ For events and product sales, payment is due in full at the time of registration or purchase and is non-refundable except as noted in Sections 4 and 5.
7. Client Responsibilities
✓ Virtual sessions: Client must ensure participants have Zoom access with functioning microphones, cameras, and internet connections.
✓ In-person sessions: Client must provide AV setup (projector/screen with Zoom access), participant workstations, and audio. NextGen XR will arrive 90 minutes before session for tech setup.
✓ Confidentiality: All simulation content, debriefs, and participant discussions are confidential and may not be shared outside the participant group without prior written consent from NextGen XR.
✓ Recording: Sessions may only be recorded with mutual written consent.
✓ Safe Environment. Client must provide a safe and suitable training environment.
8. Intellectual Property
✓ All content, including text, images, logos, and training materials, is the property of NextGen XR unless otherwise noted.
✓ You may not copy, modify, or distribute our content without prior written consent.
9. External Links
Our website may link to third-party websites (e.g., Vimeo, HubSpot, research publications). We are not responsible for the content, privacy practices, or terms of those third-party sites.
10. Disclaimer Warranties and Limitation of Liability
✓ The website and its content are provided “as is” without warranties of any kind.
✓ We do not warrant that the site will always be available, free of errors, or secure.
✓ NextGen XR is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our website, training, or services.
✓ By using our training simulations, you acknowledge they are educational in nature and not a guarantee of workplace outcomes.
✓ NextGen XR is not responsible for technical failures caused by client-side equipment, internet connectivity, or facilities.
11. Indemnification
You agree to indemnify and hold harmless NextGen XR, its team, and partners from any claims, damages, or expenses resulting from your use of the website or services.
